US Supreme Court Rejects Challenge to Abortion Pill Access
The US Supreme Court has rejected a lawsuit aimed at restricting access to the abortion pill mifepristone, ruling 9-0 in favor of preserving its availability. The plaintiffs, anti-abortion groups and physicians, lacked legal standing to bring the case as they failed to demonstrate harm caused by the FDA's regulatory actions. Specifically, the court found that the plaintiffs' "complicated causation theories" did not establish a clear link between the FDA's decisions and their alleged injuries. The ruling preserves access to mifepristone, which is used in nearly two-thirds of all abortions in the US. Notably, several justices expressed skepticism about whether any of the plaintiffs had suffered harm. The decision comes ahead of the November election, where abortion rights are a key issue.
But let's be clear: attacks on medication abortion are part of Republican elected officials' extreme and dangerous agenda to ban abortion nationwide.
But citizens and doctors do not have standing to sue simply because others are allowed to engage in certain activities.
We recognize that many citizens, including the plaintiff doctors here, have sincere concerns about and objections to others using mifepristone and obtaining abortions.
A plaintiff's desire to make a drug less available for others does not establish standing to sue.
The plaintiffs lack standing to challenge FDA's actions.
