New York Judge Rules Against Trump's Bid to Throw Out Hush Money Conviction
Donald Trump has been convicted of fraud by a New York jury and was recently ruled against in his bid to have the conviction thrown out. Judge Juan Merchan denied Trump's motion to dismiss the indictment and vacate the jury verdict, stating that the defendant's motion was denied. Trump's lawyers had argued that the case should be moved to federal court, but Merchan rejected this argument. Trump also challenged the conviction on several technical grounds, but Merchan's decision focused on the question of presidential immunity. The judge ruled that the Supreme Court's ruling on presidential immunity did not apply in this case, as the testimony at the trial related to unofficial conduct entitled to no immunity protections. This ruling raises the prospect that Trump could enter the White House with a felony conviction.
This lawless case should have never been brought, and the Constitution demands that it be immediately dismissed.
Multiple accommodations well short of dismissal... would satisfy that objective, including a stay of proceedings during his term in office.
Even if this Court did find that the disputed evidence constitutes official acts under the auspices of the Trump decision, which it does not, Defendant's motion is still denied as introduction of the disputed evidence constitutes harmless error and no mode of proceedings error has taken place.
Defendant's motion to dismiss the indictment and vacate the jury verdict... is denied.
This Court concludes that if error occurred regarding the introduction of the challenged evidence, such error was harmless in light of the overwhelming evidence of guilt.
Allegations of juror misconduct should be thoroughly investigated. However, this Court is prohibited from deciding such claims on the basis of mere hearsay and conjecture.
This Court cannot allow the public filing of unsworn, and admittedly contested statements. To do so would threaten the safety of the jurors and violate the agreed upon Order Regulating Disclosure of Juror Information.
